These Terms of Service govern your access to and use of the ITCloudNode platform. By creating an account or using our services, you agree to these terms.
1. Acceptance of Terms
By accessing or using ITCloudNode services, you confirm that you are at least 18 years of age, have the legal authority to enter into this agreement, and agree to be bound by these Terms of Service and our Privacy Policy.
If you are using the platform on behalf of a company or organisation, you represent that you have the authority to bind that entity to these terms.
2. Account Registration
You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
You must notify us immediately at contact@itcloudnode.com if you suspect unauthorised access to your account. We are not liable for losses resulting from unauthorised use of your account.
3. Services
ITCloudNode provides cloud hosting infrastructure including server provisioning, storage, networking, SSL, monitoring, and related services as described on our platform. The specific resources and features available to you depend on the plan you have selected.
We reserve the right to modify, update, or discontinue features with reasonable notice. For material changes, we will notify active subscribers at least 30 days in advance.
4. Payment & Billing
Starter and Professional plans are billed monthly. Payment is due at the start of each billing period. Enterprise plan billing terms are agreed upon individually.
- All prices are shown in EUR and are exclusive of applicable taxes unless stated otherwise.
- Failed payments may result in service suspension after a grace period of 5 days.
- Refunds are handled on a case-by-case basis. Contact us within 14 days of a charge if you believe a billing error has occurred.
- Downgrades take effect at the next billing cycle. Upgrades take effect immediately.
5. Prohibited Use
You agree not to use ITCloudNode for any unlawful, abusive, or disruptive purposes. Specifically, you may not:
- Host or distribute malware, spam, or phishing content
- Conduct denial-of-service attacks or network scanning without authorisation
- Violate the intellectual property rights of third parties
- Store or distribute content that is illegal in your jurisdiction or ours
- Attempt to gain unauthorised access to other accounts or systems
- Resell platform resources without prior written permission

6. Uptime & Support
We aim to maintain high availability for all hosted workloads. Uptime targets and support response times vary by plan. Enterprise clients receive custom SLA terms agreed in writing.
Scheduled maintenance windows will be communicated with reasonable advance notice. We are not liable for downtime caused by events outside our reasonable control, including third-party infrastructure failures or acts of nature.
7. Intellectual Property
You retain ownership of all content, code, and data you upload or deploy to the platform. You grant ITCloudNode a limited, non-exclusive licence to host and process your content solely to deliver the services you have purchased.
ITCloudNode retains all rights to the platform, dashboard, CLI tooling, and related software. You may not copy, reverse-engineer, or redistribute these without written permission.
8. Termination
You may cancel your account at any time via the dashboard or by contacting us. Cancellation takes effect at the end of your current billing period. After cancellation, your data will be retained for 30 days before permanent deletion.
We may suspend or terminate your account immediately if you breach these terms, fail to pay, or engage in activity that poses a risk to the platform or other users.
9. Limitation of Liability
To the maximum extent permitted by applicable law, ITCloudNode is not liable for indirect, incidental, special, or consequential damages arising from your use of the platform, including loss of revenue, loss of data, or business interruption.
Our total liability to you for any claim shall not exceed the total fees paid by you in the 3 months preceding the claim.
10. Governing Law
These terms are governed by applicable law. Disputes will first be attempted to be resolved through good-faith discussion. For enquiries or disputes, contact us at contact@itcloudnode.com.
We reserve the right to update these Terms of Service. Continued use of the platform after changes take effect constitutes acceptance of the updated terms. We will notify active users of material changes by email.
